Kenya Music Management in Crisis

The Kenya Copyright Board and Music Copyright Society of Kenya are in a tug of war over who is in charge of music management, Kecobo, through an announcement in the Kenya Gazette of May 6 de-registered MCSK , but the Music society still insist it is authorised to collect music license fees and royalties.
The two put up contradicting announcements on Thursday this week. "MCSK would like to confirm that they still exist as a company contrary to what had been reported by a section of the media that it had been deregistered," said Habel Kifito , the MCSK chairman.
But Kecobo sent out a caution statement to music users not to make any payments to MCSK. "MCSK has no mandate currently to collect royalties to collect royalties and license fees. Music users are advised not to make any payments to MCSK until advised to the contrary by the board," said Edward Sigei of Kecobo.
MCSK was licensed by the overall copyrights board in 2007 to collect royalties from different music users including broadcasters, PSVs, clubs, hotels, shops and restaurants. But it has over the years been under scrutiny for misappropriation of funds and failure to distribute royalties to the rights owners, the artiste.
Last year, MCSK's said it had collected about Sh183 million since enforcement began in 2007, a figure disputed by some players in the entertainment as too low.
For this there has been some resistance by most music users to pay the fees and the society was planning to take some broadcasters to court for failure to pay royalties.
